Three International Adoption Pathways
USCIS provides three legal pathways for completing an international adoption based on the child’s country of origin:
Hague Convention Adoption
- If the child’s home country is a signatory to the Hague Adoption Convention Treaty, adoptive parents must follow the Hague Process.
- Parents must complete forms I-800A and I-800, as well as consulate-specific paperwork.
- This process provides additional protections for children, birth parents, and adoptive families, ensuring ethical adoption practices.
Non-Hague Adoption (Orphan Process)
- For countries not part of the Hague Convention, parents must follow the orphan adoption process.
- USCIS requires the completion of forms I-600A and I-600.
- This process involves different documentation and approval procedures based on the child’s country of origin.
Family-Based Petition for Green Card Holders
- U.S. green card holders adopting a child from their native country may need to complete an I-130 Family-Based Petition.
- The adoptive parent must have resided in the child’s country for at least two years.
